CONSTITUTION OF THE ACADEMIC SENATE
OF SAN JOSE CITY COLLEGE
ARTICLE I. NAME
This organization shall be known as the Academic Senate of San Jose
City College.
ARTICLE II. NATURE AND
PURPOSE
The Academic Senate shall represent the entire teaching faculty in the
development of policy recommendations on all academic and professional
matters.
ARTICLE III. THE
ELECTORATE
All certificated personnel whose positions do not require an
administrative and/or supervisory credential shall be the electorate.
ARTICLE IV. ACADEMIC
SENATE REPRESENTATIVES
Section 1. The Academic Senate shall include
one member elected from each instructional area, except any area having
15 or more full-time faculty shall have two members elected. Area
representatives shall serve two-year terms. The Academic Senate shall
also include five members elected at-large for one year terms. The
electorate shall consist of full-time certificated personnel only.
The Chairperson of the Instructional Policies/Curriculum Committee
shall also serve on the Academic Senate as an additional at-large
representative. The position of Academic Senate President and I.P.C.
Chairperson shall remain separate positions, not held by the same
person. The I.P.C. Chairperson shall be selected by the members of the
I.P.C. Committee.
Section 2. The Academic Senate shall include three
members elected at large by certificated part-time hourly personnel.
These Academic Senate members shall be elected for one-year terms. In
this case, the electorate shall consist of certificated part-time hourly
personnel only.
Section 3. Representatives shall be elected from the
following twelve areas:

Section 4. Odd numbered areas shall elect
representatives in odd-numbered years. Even numbered areas shall elect
representatives in even-numbered years.
Section 5. The Academic Senate area representatives
shall be responsible for conducting elections in their respective areas.
In the event there is no area representative, the Academic Senate
President shall appoint a faculty member from the instructional area to
conduct such an election.
Section 6. Academic Senate elections shall take place
during April. The newly elected Senators shall be introduced at the
first regular meeting in May, and take office at the second regular
meeting in May.
Section 7. At the time of election as an area
representative, a senator shall be a faculty member of the area
electorate which he/she represents. In the event that a full-time member
has an assignment in more than one Academic Senate area, he/she shall be
considered to be a member of the area in which the percent of his/her
assignment is greatest.
If there are two or more areas in which a faculty member has an equal
maximum percent assignment, that faculty member shall choose one of the
areas in which he/she shall be considered to be a member. For example,
if a faculty member's assignment is divided among three areas with 40%
in one area, 40% in a second area, and 20% in a third area, this faculty
member must choose one of the two 40% areas in which he/she shall be
considered to be a member.
If, during his/her term as a Senator, a faculty member's assignment
is changed with the result that the Academic Senate area in which he/she
is considered to be a member is also changed, this Senator may continue
to represent the area from which he/she was originally elected for the
remainder of that academic year.
During April of that academic year, the electorate of that area shall
elect a Senator from among the faculty members of that area to serve the
remaining year of a two-year term or a full two-year term, whichever is
needed, consistent with Article IV., Section 4.
Section 8. A Senator may be recalled by a two-thirds
majority vote of the constituents of his/her area.
ARTICLE V. ACADEMIC SENATE
OFFICERS
Section 1. The officers shall be President,
Vice President, Treasurer, and other officers, as the Academic Senate
deems necessary to conduct its business. Such officers shall be elected
by and from members of the Academic Senate.
Section 2. Duties of
Officers
| A. |
President - The President shall preside at all
meetings of the Academic Senate. The President shall act as the
liaison officer between the Academic Senate and the students,
classified staff, college administration, district administration,
and the Board of Trustees.
The President or the President's proxy shall attend all
regularly scheduled Board of Trustees meetings, President
Information Exchange meetings, and shall represent the Academic
Senate where deemed appropriate by the Senate.
In the event that a member-at-large - full-time or part-time -
or an area representative office is vacated, the President
shall:
1.) Cause the Academic Senate to elect a member of the
electorate to fill the unexpired term of the vacated
member-at-large office. 2.) Cause the affected area to hold an
election to fill the unexpired term of the vacated representative
office. |
| B. |
Vice President - The Vice President
shall assume the duties of the President in the latter's absence.
In the event of the office of President is vacated, the Vice
President shall assume that office and fulfill its duties for the
unexpired term of the office. The Academic Senate will elect a
Vice President to fill a vacancy in that office. |
| C. |
Treasurer - The Treasurer shall be
responsible for having the Academic Senate's financial records
maintained, the Senate dues collected and funds disbursed. The
Treasurer shall fulfill the duties of the President in the absence
of the President and Vice President. |
Section 3. Election of
Officers
| A. |
At the first regular meeting in May, the Senate
shall appoint a nominating committee of three Senate members from
those who will be serving as Senators during the coming year. The
committee shall choose its own Chairperson. The committee will
receive the names of nominees and shall conduct the election of
Officers. During the election of officers, the Nominating
Committee Chairperson shall present the nominees. |
| B. |
The election of Academic Senate officers shall
take place at the second regular meeting in May. |
| C. |
The duly elected officers shall take office at the
first regularly scheduled meeting in the Fall
Semester. |
ARTICLE VI.
MEETINGS
Section 1. The Academic Senate shall meet
regularly as needed when called by the Academic Senate President. All
meetings shall be open except at such time as the Senate votes to go
into an Executive Session as specified in Article VI., Section 3.
Section 2. A quorum is a minimum of fifty percent plus
one of the Senators on the roster.
Section 3. An Executive Session of the Academic Senate
may be held only by a two-thirds consent of the Senators present in a
regularly scheduled meeting and is open to Senate members only.
ARTICLE VII. FACULTY MEETINGS
(GENERAL)
Section 1. The Academic Senate shall call a general
meeting of the electorate as needed, or on receipt of a petition signed
by 15 or more full-time instructors.
Section 2. At such a general meeting, a majority vote
by secret written ballot by Senators only shall determine whether any
given matter will be taken to a vote of the general
electorate.
ARTICLE VIII.
COMMITTEES
The Academic Senate shall appoint faculty representatives to the
following committees, and others as needed:
Section 1. Standing
Committees - Standing committees shall have the representation
of three faculty members. In every case, the faculty shall be the
largest single group on standing committees. The Academic Senate
standing committees include: Instructional Policies and Curriculum
Committee, Professional Rights and Responsibilities Committee, and
others as needed.
District Committees include: District Budget Committee,
District Program Review, Professional Recognition Committee, and others
as needed.
ARTICLE IX.
PROCEDURES
Section 1. By-Laws shall be adopted and amended by a
two-thirds vote of the Academic Senate.
Section 2. Changes to the By-Laws shall not be proposed
and adopted at the same Senate meeting.
Section 3. In addition to the By-Laws, the Academic
Senate shall adopt or amend Ground Rules for the conduct of its business
with a majority vote.
Section 4. The rules contained in Roberts' Rules of
Order shall govern the Academic Senate in all cases to which they are
applicable and in which they are consistent with the By-Laws, Ground
Rules, or this Constitution.
ARTICLE X. AMENDMENTS
Amendments to this Constitution must be approved by a two-thirds
majority of the votes cast in a general election of the faculty
electorate.
